1. Acceptance of Terms
By accessing or using CartoChrome ("the Service"), including the website at cartochrome.com, the CartoChrome API, and any associated services, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not access or use the Service.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email or prominent notice on the Service.
2. Description of Service
CartoChrome provides interactive healthcare access mapping, Healthcare Access Scores for US ZIP codes, healthcare provider and facility profiles, and related data services. The Service includes free public access to maps and scores, premium features for healthcare providers, a public API for developers, and embeddable widgets for third-party websites.
CartoChrome uses publicly available government data sources to compute healthcare access metrics. While we strive for accuracy, scores are statistical estimates and should not be the sole basis for healthcare decisions.
3. Use License
Subject to these Terms, CartoChrome grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. For commercial use, including API access, widget embedding, and data integration, a separate license is required under our API Terms of Service.
You may not: (a) copy, modify, or distribute the Service or its content except as expressly permitted; (b) use the Service to build a competing product; (c) attempt to reverse-engineer any portion of the Service; (d) scrape, crawl, or harvest data from the Service by automated means without API authorization; (e) use the Service for any unlawful purpose.
4. User Accounts
Some features require a registered account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current information during registration and keep your profile information up to date.
CartoChrome reserves the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.
5. Provider and Facility Profile Claims
Healthcare providers and facilities may claim their profiles on CartoChrome to verify their identity, update information, and access premium features. By claiming a profile, you represent that you are authorized to manage the listing for that provider or facility.
CartoChrome verifies provider identities through NPI verification and may request additional documentation. Claimed profiles must contain accurate, truthful information. Misrepresentation of provider credentials, affiliations, or services is prohibited and may result in profile removal and account termination.
6. API Usage
Access to the CartoChrome API is subject to rate limits, usage quotas, and pricing as described in the API documentation. API keys are non-transferable and must not be shared or embedded in client-side code. You are responsible for all usage under your API key.
CartoChrome may modify, suspend, or discontinue API access at any time with reasonable notice. We will provide at least 30 days notice for material changes that affect paid API subscribers.
7. Intellectual Property
The Service, including its scoring methodology, software, design, and proprietary data derivatives, is owned by CartoChrome and protected by intellectual property laws. The underlying public government data used in our calculations is not subject to copyright and remains in the public domain.
The CartoChrome name, logo, and brand elements are trademarks of CartoChrome. You may not use these marks without prior written permission, except as necessary to truthfully describe the source of health score data when using our API or widget.
8. Medical Disclaimer
CartoChrome is NOT a medical service and does not provide medical advice, diagnosis, or treatment. Health scores, provider profiles, facility ratings, and all other information on the Service are for informational and educational purposes only.
Healthcare Access Scores measure geographic access to healthcare services. They do not evaluate the quality of care you will personally receive, diagnose medical conditions, or replace professional medical advice. Always consult a qualified healthcare provider for medical decisions.
In a medical emergency, call 911 or your local emergency number immediately. Do not rely on CartoChrome to find emergency services.
9. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
CartoChrome does not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) health scores or other data will be accurate or current; (c) provider or facility information will be complete or up to date; (d) any errors will be corrected.
10. Limitation of Liability
To the maximum extent permitted by law, CartoChrome and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of the Service.
In no event shall CartoChrome's total liability exceed the amount you have paid to CartoChrome in the twelve months preceding the claim, or $100, whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless CartoChrome and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you submit through the Service.
12. Termination
CartoChrome may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimer, limitation of liability, and indemnification sections.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
